1. TERMS OF SERVICE

This FileLu Service Agreement (the 'Agreement') describes the terms and conditions on which FileLu ('we,' 'us') provides services to you ('User') through our website, including https://filelu.com and https://file.lu, including subdomains and related sites ('Website'), our mobile apps ('mobile apps'), our FileLuSync desktop app ('desktop app'), our Linux terminal CLI script, and our application programming interface ('API'). It is essential that you read this Terms of Service in its entirety. By creating an account or using our service, you agree to be bound by its terms. By using our services, you also agree to FileLu's Privacy & Cookie Policy and the following terms:

• 1.1 FileLu's have the right to delete, move or replace any files which come under the category of copyrighted material, harassment, or offensive material and have no responsibility for lost images, videos, or any files that are upload on FileLu.
• 1.2 We reserve the right to disable direct linking on user accounts that are using excessive bandwidth or otherwise abusing the system.
• 1.3 You are responsible for maintaining the confidentiality of the password, encryption key, and your account security and are fully responsible for all activities that occur under your password or account. You agree to immediately notify FileLu of any unauthorized use of your password or account or any other breach of security, and ensure that you sign out from your account at the end of each session.
• 1.4 FileLu's have the right to ban or suspend the account of any user who will not follow rules and FileLu Terms of Service.
• 1.5 FileLu's have the right to remove any contents that compromise the security of FileLu servers.
• 1.6 FileLu's have the right to terminate, suspend, block or remove your account or files in case of any security threat or in exceed of bandwidth or exceed in limitation given to the type of account.
• 1.7 Users are strictly prohibited from creating multiple accounts on FileLu. Doing so may result in service restrictions or unintended technical issues, including potential file corruption during encryption and decryption processes.
• 1.8 You must maintain copies of all data stored by you on our services. We do not make any guarantees that there will be no loss of data or the services will be bug-free. You should download all data prior to the termination of services.
• 1.9 Recieving emails from FileLu. All emails we send to you are related to your account e.g registration confirmation email, security confirmation email, your file expired soon notifications email, or when you request to reset your password we will send out an email for you to confirm...etc. When you sign in and sign up for an account on FileLu you agree to receive and give us permission to send you those kinds of emails. We recommend you add this email [email protected] to your email contact list to make sure you receive all the important emails related to your FileLu account.
• 1.10 We will store your data on our service subject to these terms and any plan you subscribe to. If you choose to stop using our services or stop payment, you must download your data first because after that your files may be expired and auto-delete when you downgrade from Premium to Regular user.
• 1.11 Uploading content related to child abuse or animal abuse will result in an immediate ban. FileLu is very strict about child abuse, and in such cases, FileLu will fully cooperate with legal authorities and law enforcement by providing all necessary support and information.
• 1.12 We reserve the right to disclose data and other information as required by law or any competent authority. If we think it is necessary or we are obliged by law in any jurisdiction, then we are entitled to give Your Files or any Account Data and any Usage Data to competent authorities, even if those items are encrypted.
• 1.13 We respect the copyright of others and require that users of our services comply with copyright laws. Users must agree to comply with all laws which apply to their location, including copyright and trademark laws. Images, videos, apps, docs, or any files that violate copyrights or trademarks are not allowed. If someone has an infringement claim against you, we will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us. we will remove the copyrighted file until the issue is resolved. If there is a dispute between participants on this site, FileLu is under no obligation to become involved.
• 1.14 We process all takedown notices based on good faith acceptance of the representations from the party submitting the takedown notice.
• 1.15 For copyright takedown notice please follow DMCA Copyright Takedown Notice. If FileLu receives proper notification of claimed copyright infringement it will respond expeditiously by removing or disabling access to, the material that is claimed to be infringing or to be the subject of infringing activity. Please note that FileLu will not necessarily send a confirmation about the takedown actions to the reporter.
• 1.16 You may not upload, download, store, share, access, display, stream, distribute, e-mail, link to, communicate, transmit, or otherwise make available any files, data, or content that infringes any copyright or other proprietary rights of any person or entity.
• 1.17 Every time you violate our policies you will get 1 strike. Each strike will not expire until 30 days from the time it was issued. 3 strikes in the same 30-day period result in your account being suspended.
• 1.18 While using FileLu service you agree, that you may not:
  1. - Uploading any child abuse, animal abuse, harassing, threatening, intimidating, unlawful.
  2. - Contains, promotes, or links to shocking content, terrorism, weapons, tobacco, drugs, hacking, virus, malware or any illegal material;
  3. - Promotes depicts or links to material that promotes or depicts discrimination based on race, gender, religion, national origin, physical or mental disability, sexual orientation, or age;
  4. - Contains unlawful material, including but not limited to materials that may violate another's intellectual property rights, or links to a site that contains such material;
  5. - Contains information regarding, promoting, or links to a site that provides information or promotes illegal activity; or for any other reason that is deemed by us to be unsuitable;
  6. - Assign or transfer any rights you have under these terms to any other person (including by sharing your password with someone else);
• 1.19 The user is responsible to keep your password and master encryption key in a safe place. If you lost your master key you are unable to create the new one nor access your encrypted files.
• 1.20 FileLu is a free file hosting site that allows users to upload, store and share files. Registered users can upload and share their files on FileLu with their friends, family anywhere on the worldwide web. FileLu is not responsible for the contents that users upload on this website. If you see any contents that are illegal or infringe please report to us by email at: [email protected] and we will remove that file asap (please include the reason for the report in the Subject:).
• 1.21 You are solely responsible for everything you upload, share or any interactions you have through FileLu.
• 1.22 FileDrop liability: FileDrop is the feature that allows others to upload files to your account (your folders). If you are the folder owner, you are solely responsible for all files that store in your account.
• 1.23 Remove inactive or abandon accounts: FileLu reserves the right to remove and delete any account that has been inactive for 180 days or more. That means if a user does not log into their account within 180 days, their account will be subject to removal and deletion by FileLu. This policy is in place to ensure the security and privacy of our active users, as well as to maintain the integrity of our system by removing any inactive, spam, or abandoned accounts. However, this policy only applies to Regular ( Free ) users. Premium users who maintain their Premium status do not need to worry about their account being removed or deleted for inactivity. As a courtesy, we will send out an email reminder to the account owner before deletion, allowing you to log in and maintain your account. All notifications will send from email: [email protected] .
• 1.24 Remove Files When Exceeding Storage Limit
  • Free Plan: If a user exceeds their 10 GB free storage limit, the system will automatically delete files until the total storage used is back to 10 GB.
  • Premium Plan: If a user exceeds the 10 GB free storage but later downgrades from Premium, they must restore their Premium status within 30 days. If the account is not upgraded within this period, the system will automatically delete files to bring storage usage back within the free plan limit.
• 1.25 FileLu is not liable for your images, videos, docs, apps, or any files type or any loss of business or personal due to the unavailability or loss of the website. We make no claims of future reliability in serving, hosting, or storing your files.
• 1.26 Additionally, FileLu is not responsible for file loss or account limitations due to payment declines or issues preventing automatic payment renewal. To avoid interruptions, please ensure your payment method remains valid and up to date.

2. Data Deletion Policy

We respect your right to privacy and understand that you may wish to delete your data from our servers at any time. Upon receiving a request for data deletion, we will promptly remove all personal data associated with your account, including any files, metadata, and other information that can be used to identify you. Please note that we may need to retain some data for legal compliance purposes, such as transactional data or billing information, as required by relevant laws. We may also retain data to protect our interests in case of legal disputes. However, we will only retain such data for as long as necessary and will have policies in place to securely delete it when it is no longer required. By using our services, you agree to the terms of this Data Deletion Policy and understand that we may need to retain certain data for legal compliance purposes.

3. Referral Program

Our platform offers a referral program that allows users to earn additional storage space by referring friends and new users to our service. To ensure the integrity of the program, referred users must create an account with a valid username, password, and verify their email address. Only referrals who have completed the registration process with a verified email address, username, and password will be considered valid. Any referrals that do not meet these requirements will not be eligible for the referral program rewards. We encourage users to refer individuals who are genuinely interested in our services and willing to participate in the platform as active members. Creating multiple accounts for the sole purpose of increasing referral rewards is strictly prohibited and may result in the cancellation of the referral program for the involved user(s) and account consequences as outlined in our terms of service. Please note that we reserve the right to review and validate referrals to ensure compliance with these requirements. We aim to maintain a fair and transparent referral program that rewards genuine user participation.

4. Trademarks

The FileLu.com logo, the word "FileLu" or "FILELU" and the slogan contained on the Site (or made available via the Service) are trademarks of FileLu, LLC and its suppliers or licensors, and may not be copied, imitated, or used, in whole or in part, without the prior written permission of FileLu.com or the applicable trademark holder. You may not use any metatags or any other "hidden text" utilizing "Filelu.com" or any other name, trademark or product, or service name of FileLu.com without our prior written permission. In addition, the look and feel of the Site and the Service, including all page headers, custom graphics, button icons, and scripts, is the service mark, trademark, and/or trade dress of FileLu.com and may not be copied, imitated or used, in whole or in part, without our prior written permission. All other trademarks, registered trademarks, product names and company names or logos mentioned on the Site (or made available via the Service) are the property of their respective owners. Reference to any products, services, processes, or other information, by trade name, trademark, manufacturer, supplier, or otherwise does not constitute or imply endorsement, sponsorship, or recommendation thereof by us.

5. Cancel Anytime

You may cancel your subscription to FileLu Premium at any point prior to your next billing period, no questions asked. Cancel Recurring Payment

"Cancel anytime" means you can turn off the auto-renewal for your subscription whenever you'd like. If you do so at least 48 hours prior to your renewal date, you will not be charged for subsequent billing periods after that. If you do not cancel at least 48 hours before your renewal date, your subscription will be automatically renewed, and your account will be charged using the payment method on file. Refunds will not be provided for renewal charges if you fail to cancel before the renewal occurs, regardless of whether you have used the service after renewal.

6. Recurring Paid Subscriptions

Recurring subscriptions will renew indefinitely, either monthly (every 30 days) or annually (every 365 days), based upon your chosen subscription period, unless the subscription is canceled prior to the renewal date. For recurring subscriptions established via mobile apps using in-app purchase platforms, please refer to your app store account for the dates and terms of your subscription. Any other recurring subscription will renew on the same day of the month as it was established, except in cases where the day is not available due to a short month, in which case the renewal date will move to the first or second day of the following month. We reserve the right to change our Premium plan prices at any time. New orders will reflect the updated prices. If you purchased a Premium plan before the price change, your subscription will continue to renew at the old price until you cancel or update your plan.

For the Free plan and Unregistered plan state that we reserve the right to make changes to the plan at any time and without prior notice. This includes, but is not limited to, changes to the features, functionality, and limitations of the plan. By using the Free plan, you agree to these terms and understand that any changes made may impact your use of the service.

7. One-Time Payment Plan (Lifetime Plan)

Our "One-Time Payment Plan" is available for purchase and is valid for 99 years from the date of purchase, as long as our business continues to operate. We have defined a Lifetime account as 99 years or the lifetime of the account holder, whichever is shorter. However, please be aware that this plan is non-transferable and cannot be resold. It is intended for the exclusive use of the individual who purchases it and cannot be passed on to the next generation or any other party. Please note that after the 99-year period, the Lifetime Plan will expire, and access to its benefits will cease. If you wish to continue using our services beyond this period, you must repurchase a suitable plan or subscription.

8. Refund Policy

• FileLu may approve a fifteen (15) day money-back guarantee. If you are not satisfied with the service, you can request a refund within 15 days of purchase. Refund requests should be submitted by email to [email protected] or create support ticket.
• This money-back guarantee is applicable only to first-time purchases. Subsequent purchases, renewals, or upgrades are not eligible for refunds under this policy.
• FileLu reserves the right to deny refund requests in cases where abuse of the refund policy is detected, such as repeated refund requests from the same user account or associated accounts.
• Refunds may require the user to provide a valid reason for the request. Requests without sufficient reason may not be approved.
• Cancellation. You may cancel your FileLu Premium at any time. Refunds are only issued if required by law. Please note that if you wish to delete your account, you must cancel your FileLu Premium subscription and any recurring payments before doing so. Failure to cancel your subscription and recurring payments may result in continued charges even after your account has been deleted.

9. Disputed Payments and Chargebacks

If you dispute a valid charge (including a subscription renewal) with your bank or payment provider instead of contacting us for support or cancellation, we reserve the right to terminate or permanently suspend your account and all associated services. Filing a chargeback for a legitimate transaction violates our Terms of Service. To resolve any billing issues, please contact our support team before initiating a dispute.

10. Disclaimer

Though FileLu has applied strict rules and regulations to regulate all the file-sharing behavior and continuously and vigilantly monitors the types of files uploaded to its servers, FileLu is not responsible for the content of any uploaded files, nor is it in affiliation with any entities that may be represented in the uploads by users. FileLu will attach importance to your abuse and copyright reports and will take appropriate action within 12 hours!

We don't give you any warranty or undertaking about the services or the website which are provided "as is". To avoid doubt, all implied conditions or warranties are excluded as much as is permitted by law, including (without limitation) warranties of merchantability, fitness for purpose, safety, reliability, durability, title, and non-infringement.

FileLu is not liable for your images, videos, docs, apps, or any file type, or any lost business or personal loss, loss of profits, loss of revenue, loss of use due to the unavailability or loss of the website. We make no claims of future reliability in serving, hosting, or storing your files.

Disclaimer of Liability: The Service is provided on an "as is" and "as available" basis. FileLu makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, materials, or products included on the Service. FileLu will not be liable for any damages of any kind arising from the use of the Service, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

Limitation of Liability: In no event shall FileLu be liable for any lost profits or business interruption, or any indirect, special, incidental, or consequential damages arising out of or in connection with the use or inability to use the Service.

11. Miscellaneous Legal

The Agreement, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by FileLu without restriction.

12. Penetration Testing

Prior to conducting any penetration testing on FileLu systems, users must obtain explicit permission from FileLu. Requests for such testing should be directed to [email protected]. Unauthorized penetration testing may result in legal action.

Indemnification: You agree to indemnify and hold FileLu and its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.

Changes to Terms of Service: We will not modify this term of service arbitrarily. However, because the ways in which the internet is used and abused evolve over time, we reserve the right to modify it anytime. If we do, we will post the notification on our home page. Your continued use of the Service after any such changes constitutes acceptance of the new Terms.

The Agreement shall be construed in accordance with the laws of the State of Florida, without reference to principles of choice of law. You and FileLu each irrevocably consent to the personal jurisdiction of the federal or state courts located in Orange County, Florida ("Courts") with respect to any action, suit, or proceeding arising out of or related to the Agreement or to the Services and/or Content and waive any objection to venue in any of the Courts for such an action, suit, or proceeding. Additionally, you agree that you will not bring any such action, suit, or proceeding in any court other than the Courts.

These Terms of Service, together with the Privacy Policy and any other legal notices published by FileLu on the Services, constitute the entire agreement between the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter. If any inconsistency exists between the terms of the Agreement and any additional terms and conditions posted on the Services, such terms shall be interpreted as to eliminate any inconsistency, if possible, and otherwise, the additional terms and conditions shall control. If any provision of the Agreement is held invalid, illegal, or unenforceable in any respect, (i) such provision shall be interpreted in such a manner as to preserve, to the maximum extent possible, the intent of the parties, (ii) the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby, and (iii) such decision shall not affect the validity, legality, or enforceability of such provision under other circumstances.

No failure or delay in exercising or enforcing this policy shall constitute a waiver of the Agreement or any other right or remedy. If any provision of the Agreement is deemed unenforceable due to law or change in law, such a provision shall be disregarded and the balance of the Agreement shall remain in effect.

Limitation of Claims: YOU AND FILELU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ARISES; OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

All disagreements will be heard in Orange County, Florida, USA within one year.

You’re over 18 and have authority and permission to accept this Agreement or between 16 and 18 and your parents have accepted this Agreement on your behalf. If you are under 16 years of age, then do not use the Service.
